Eligibility

Services are available to individuals and businesses who can form legally binding contracts under applicable law and who are acting within the scope of their professional role as realtors or property professionals.

Users must be at least 18 years old to register for services that require an account or to enter into paid engagements with Agenttopright.

You must use our services lawfully and not for any purpose that is fraudulent, unlawful, or infringes third-party rights. Illegal use may result in suspension and referral to authorities.

Availability of specific services may be limited to clients operating in Thailand or to matters governed by Thai law. Where services involve cross-border issues, additional terms may apply.

Accounts and access

Creating an account allows access to client portals, document storage, and secure messaging. You are responsible for maintaining accurate account details and for all activity under your account.

Provide truthful and complete information during registration and update details promptly if they change. Misleading or false information is grounds for termination of service.

Keep account credentials confidential. If you suspect unauthorized access, change your password immediately and notify Agenttopright so we can take protective measures.

Accounts are personal and non-transferable. Assignments of accounts require prior written approval from Agenttopright.

If you believe your account has been compromised, contact us immediately at +66953823315 so we can secure your account and advise on next steps.

We may suspend or restrict access to accounts for security reasons, suspected abuse, or non-payment of fees. We will provide notice where practical.

Scope of services

Agenttopright provides legal consultancy, document review, contract drafting, and compliance advice specifically for realtors and real estate transactions in Thailand. Scope is set out in engagement letters or service proposals.

We may modify the scope, features, or availability of services. Changes will be communicated via email or the client portal. New terms for modified services will apply from their effective date.

While we aim to provide continuous access to online resources, availability may be affected by maintenance, third-party outages, or unforeseen events. We will notify clients of scheduled downtime where possible.

User responsibilities and rules

When using Agenttopright services and website, users must comply with the following rules to ensure lawful, professional, and secure operation.

• Use services only for lawful activities related to real estate and property transactions.
• Do not attempt to bypass security measures, access other accounts, or interfere with platform operations.
• Respect intellectual property rights of Agenttopright and third parties; do not upload infringing content.
• Provide accurate information in communications and documents submitted to Agenttopright professionals.
• Avoid sharing login credentials and promptly report suspected unauthorized access.
• Follow any additional guidelines issued in engagement letters, service agreements, or the client portal.
• Refrain from using our branding or name in communications without prior written permission.

Client content and materials

Clients may upload documents, contracts, and other materials for review. You retain ownership of your content subject to the licenses you grant Agenttopright to provide services.

You represent that you own or have rights to submit materials and that submission does not infringe third-party rights. Keep backups of original documents.

By submitting content you grant Agenttopright a non-exclusive, revocable license to use, reproduce, and process materials as necessary to deliver the requested services.

You are responsible for the accuracy and completeness of submitted materials and for informing us of any material changes affecting the matter under advice.

We will delete or return client content in accordance with the engagement agreement or upon request, subject to retention for recordkeeping and legal compliance.

Intellectual property

All Agenttopright activity, software, templates, and proprietary materials are our intellectual property. Use is permitted only as expressly authorized in writing or within the scope of commissioned services.

• Do not reproduce, distribute, or create derivative works from Agenttopright content without permission.
• Respect copyright notices and do not remove ownership markings from materials.
• Report suspected IP infringements to our contact address promptly.

Paid services and fees

Paid engagements are governed by a proposal or engagement letter specifying services, timelines, and fees. Payment obligations arise upon acceptance of the engagement terms.

Fees are set out in the engagement agreement. Pricing reflects professional time, document preparation, and specialist review tailored for real estate transactions.

Payments are accepted by methods listed in the invoice. Invoices are due by the agreed payment date. Late payments may incur administrative fees or suspension of services.

Subscription services, if offered, will have terms describing billing cycles and included features. Cancelation terms for subscriptions are defined in the subscription agreement.

Refunds are handled on a case-by-case basis depending on the type of service and the stage of the engagement. If a refund is appropriate, it will be processed after assessment and in accordance with the engagement terms.

Clients may cancel services as set out in the engagement letter. Cancellation may result in charges for work already performed and any non-recoverable costs incurred on the client's behalf.

Clients are responsible for any applicable taxes related to fees charged. Agenttopright will itemize applicable taxes on invoices where required by law.

We reserve the right to change prices for future services. Existing engagement rates remain subject to the terms agreed at the time of contracting.

Non-payment may result in suspension of services and recovery actions. Outstanding amounts may accrue interest as specified in the engagement agreement.

Professional disclaimer

Limitation of liability

To the extent permitted by law, Agenttopright's liability for direct damages arising from professional services is limited to fees paid for the relevant engagement. We are not liable for indirect, incidental, or consequential losses. Clients should secure appropriate insurance where relevant.

Third-party services

We may recommend or integrate third-party services to facilitate transactions. Agenttopright does not control third-party operations and is not responsible for their actions or failures. Use third-party services subject to their terms.

Termination

Either party may terminate the engagement in line with the contract terms. Termination does not remove obligations accrued prior to termination, including payment for services rendered.

On termination, we will deliver work product completed to date and provide reasonable assistance for transfer to another advisor, subject to settlement of outstanding fees and expenses.

Privacy and data protection

Agenttopright collects and processes personal data to deliver legal services, comply with legal obligations, and manage client relationships. Our privacy practices are described in the privacy policy available at agenttopright.pro/privacy.

Communications and notices

Notices may be sent by email, postal mail to the address on file, or by publication on agenttopright.pro. Important client communications may be delivered through the client portal.

Changes to terms

We may update these terms from time to time. Significant changes will be communicated and will apply from the effective date published on our website.

Governing law

These terms and any disputes arising from them are governed by the laws of Thailand. Where applicable, parties may agree to alternative dispute resolution methods prior to litigation.

Dispute resolution

Clients should raise disputes promptly with Agenttopright. We encourage resolution through direct negotiation or mediation. If unresolved, disputes may be brought before competent courts in Thailand.
